2. General

Terminology

About the terms used in this data protection declaration, we refer to the definitions in Art. 4 DSGVO.

When visiting our website, personal data such as inventory data, contact data, content data, contract data, usage data and meta and communication data of customers, interested parties and visitors to this online offer are processed.

Legal basis

The legal basis for the processing of the data is found in Art. 6 (1) DSGVO. Insofar as the processing of the data is based on our legitimate interest, the legal basis is Art. 6 (1) lit. f DSGVO, whereby our legitimate interest is usually the secure and efficient operation of this online offer or our economic interest. If we process your data based on your consent, the legal basis is Art. 6 (1) and Art. 7 DSGVO. If we process your data to fulfil our own obligations, the legal basis for this is Art. 6 (1) lit. c DSGVO. If vital interests of the data subject or another natural person make the processing of personal data necessary, Art. 6 (1) (d) DSGVO is the legal basis for the processing.

SSL encryption

Communication with our website takes place exclusively by means of SSL encryption. Thus, all data transmitted for the use of our website is encrypted.

External service providers

We use external service providers to operate our website. In doing so, it may happen that they gain knowledge of your personal data.

Cooperation within the framework of a contract processing relationship with external service providers takes place exclusively on the basis of a contract processing agreement (Art. 28 DSGVO), as well as on the basis of our legitimate interests in an efficient and secure provision of this online offer, on the basis of a consent granted by you or on the basis of a legal permission (e.g. if the transfer is necessary for the fulfilment of a contract).

Each service provider is checked before working with us. In particular, we take a critical look at the technical and organisational measures taken by them for data protection and data security. Only if it is ensured that the legally stipulated contractual regulations for the protection of your personal data are adhered to, will a cooperation take place.

 

3. Collection of access data and log files

Already when visiting our website, certain data are processed by us or our hosting service provider based on our legitimate interest within the meaning of Art. 6 (1) lit f DSGVO. This includes IP address, date, time, accessed file / page / resource, as well as browser information.

After 7 days, the IP address is deleted from all systems related to the use of this website, until then storage is required for security reasons. The remaining data is stored for a longer period, but a personal reference can no longer be established after the IP address has been deleted.

In exceptional cases, the data will be stored for a longer period, namely if the storage is necessary for evidence purposes. The data will then be deleted after the incident has been clarified.

 

4. Contacting us

When you contact us, for example by e-mail or contact form, personal data is collected. Which data is collected when the contact form is used can be seen from the contact form and the data you enter in it. The data collected is stored exclusively for the purpose of answering your request or contacting you to answer your request and for the associated technical administration. The data will not be passed on to third parties. The legal basis for the processing of this data is Art. 6 para. 1 lit. f DSGVO, whereby our legitimate interest is to respond to your request.

You have the right to object to the processing of your data at any time with effect for the future. In this case, your personal data will be deleted immediately.

Your personal data will also be deleted without your objection once we have processed your request. This also happens if the storage is inadmissible for other legal reasons.

 

5. Cookies

We use cookies to make your visit to our website as attractive as possible and to enable you to use certain functions. Cookies are small text files that are stored on your end device via your browser. A distinction is made between session cookies, which are automatically deleted by your browser when you end your visit to our website, and cookies that enable your browser to be recognised the next time you visit our website (persistent cookies). 6. Further integrated contents and services of third parties

a) external service providers

Hosting

For the provision of our online offer we use a service provider for hosting services. This serves to provide, among other things, computing capacity, storage space, security services, i.e. services that are necessary for the operation of this website. This also represents our legitimate interest within the meaning of Art. 6 Para. 1 lif. F DSGVO.

Analysis using Google Analytics

We also use a CRM system from a third-party provider.

We also use this on the basis of an order processing agreement. This system helps us to optimally adapt our website to your needs. A session cookie is stored by this system when you use our website. This is necessary for the allocation of customer data. It is deleted again after each session and therefore does not remain on your computer.

The analysis tool is Google Analytics.

We also use Google Analytics on the basis of our legitimate interest within the meaning of Art. 6 (1) lit. f DSGVO and an order processing agreement, because it helps us to optimise our offer as well as the economic operation of the website.

Google Analytics is a web analytics service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”).

Google Analytics uses so-called “cookies”. Cookies are text files that are stored on your computer and enable an analysis of your use of the website.

The information collected with the help of these cookies about the use of our website, as well as the shortened IP address, is transferred to a Google server. This is usually located in the USA. The data is then stored here.

The data stored there is evaluated by Google on our behalf so that we can obtain an overview of the activities within this online offering. Pseudonymous user profiles can be created from the processed data.

We use the analysis tool exclusively with an add-on that ensures that the IP address is anonymised. Anonymisation here means that the IP addresses are shortened by the last two octets before any use for the analysis of usage behaviour. This means that a personal reference can no longer be established. This shortening is carried out within Member States of the European Union or in other contracting states of the Agreement on the European Economic Area; only in exceptional cases is the full IP address transmitted to a Google server in the USA and shortened there.

b) Tools und other

Within our website, we use content and service offers from third-party providers. We use these on the basis of our legitimate interest in optimising and economically operating our website (Art. 6 (1) f DSGVO). For example, we use street maps to enable you to see exactly where our office is located in order to make it easier for you to find us.

In order for the content to be displayed on our website by the third-party provider, it is necessary for your IP address to be perceived by the third party. This is the only way they are able to send the content to your browser.

Google Maps

On our website we use Google Maps (API) from Google LLC., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). Google Maps is a service that allows maps to be displayed on the website.

When you call up a sub-page that contains such a map, information such as your IP address is transmitted to Google’s server in the USA and stored there.

If you have a Google account and are logged in, the data will also be directly assigned to your account.

If you are a Google member and do not want Google to link the data collected about you to your Google account, you can prevent this by logging out and deleting your cookies before visiting our website.

Even if you are not a member or are not logged in, Google stores the data as usage profiles and evaluates them on the basis of its legitimate interests in displaying personalised advertising, market research and the needs-based design of its website (Art. 6 para. 1 lit. f DSGVO).

You have the right to object to this creation of user profiles. To exercise this right of objection, you must contact YouTube.

Google Fonts

In addition to the maps from Google Maps, we also integrate fonts from the provider Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. The use of Google Web Fonts enables us to guarantee a uniform presentation of our online offer and thus represents a legitimate interest within the meaning of Art. 6 para. 1 lit. f DSGVO.

For this purpose, it is necessary for your browser to establish a connection with Google’s servers. In doing so, Google obtains knowledge of your IP address. Your browser then loads the web fonts into your browser cache.

7. Data subject rights

The applicable data protection law grants you comprehensive data subject rights. You have legal rights to information, correction, deletion, restriction of processing and objection to processing as well as a right to data portability. In addition, you can revoke any consent you may have given to processing at any time and complain to a supervisory authority.

Insofar as we process your data on the basis of our overriding legitimate interest, you have the right at any time to object to this processing with effect for the future on grounds arising from your particular situation.

9. Duration of the storage of personal data

As a matter of principle, we only store your data for as long as processing is necessary for the purpose for which the data was originally collected. We store your personal data for a maximum of as long as the respective statutory retention periods provide for. We therefore store your data for 6 years in accordance with Section 257 (1) of the German Commercial Code (HGB) and for 10 years in accordance with Section 147 (1) of the German Tax Code (AO), insofar as your data is covered by these statutory retention periods.

After expiry of these periods, your data will be routinely deleted unless it is required for the fulfilment or initiation of a contract and there is no legitimate interest for us to continue processing it.
